By placing any order or making any payments, you acknowledge that you have read and accepted these Terms and Conditions, Our Privacy Policy, any order form, or any payment instructions.
Payment for Goods
All goods purchases must be paid in full before shipment. Accepted payment methods include PayPal (account or credit card), credit card, or bank transfer.
Services include, but are not limited to: scuba diving packages, single dives, diving courses, experiences, snorkeling packages, sea excursions, scuba equipment hire, boat hire, Scuba Team Building, underwater weddings, and other related services. Your agreement is with EDA FZE. Services are only confirmed upon full payment.
Before your booking is confirmed, we reserve the right to adjust web/destination prices. It is only upon receipt of our confirmation email that a binding contract exists.
You must ensure that all participants in your diving booking hold valid international diving certification (or are enrolled in a course with Us). You are also required to provide proof of good health to dive, including a valid doctor’s certificate (within 1 year) if relevant medical history exists.
If you have not dived recently, a check dive or scuba review may be required (as per the policy outlined below). Ensure this is booked in advance to avoid delays:
Check dive required if:
- You have less than 50 logged dives and it has been over 6 months since your last dive (PADI Open Water Diver or equivalent).
- It has been over 1 year since your last logged dive, regardless of certification.
Scuba Review required if:
- It has been over 2 years since your last logged dive, regardless of certification.
To confirm your booking, services must be paid in full within 5 days of receiving the invoice. Payment methods include PayPal (account or credit card) or bank transfer.
If you wish to change any aspect of your diving booking after the invoice has been issued, we will do our best to accommodate the change, but it may not always be possible. Any requests for changes must be made in writing by the person who made the original booking. Changes may incur administrative charges and additional costs.
If a participant is unable to travel due to illness, the death of a close relative, jury service, or another significant reason, we will transfer the booking to another person, subject to both parties accepting liability for the full payment. At least 14 days’ notice is required.
For cancellations, please contact us in writing. Cancellations will be processed as follows:
- 60 days prior to departure: 90% refund (bank charges and first deposit excluded)
- 45 days prior to departure: 75% refund (bank charges and first deposit excluded)
- 30 days prior to departure: 50% refund (bank charges and first deposit excluded)
No refunds will be given for unused services once you are at the destination. Travel insurance may cover you if you are unable to complete pre-paid services.
We will not be liable for compensation if a booking must be altered or canceled due to events outside our control, such as transport issues, weather, or other unforeseen circumstances.
In the event we must cancel your booking, we will offer you:
- An alternative service of equivalent or similar standard and price, if available;
- A diving arrangement of a lower standard and a refund of the difference;
- A full refund of all money paid.
We accept responsibility for failures in services that are directly caused by Us, our agents, or suppliers. However, we are not responsible for any injury, death, or failure of your diving arrangements caused by your actions or circumstances outside our control.
The maximum compensation for non-personal injury claims is limited to twice the price of the diving service paid, excluding insurance premiums and amendment charges.
While we make every effort to ensure the accuracy of our advertising material, it is your responsibility to confirm that the package you purchase is correct. Changes may occur due to local conditions, weather, or other factors. We strive to keep all advertising materials up-to-date and appreciate any corrections you may notice.
If you have a complaint during your holiday, inform the responsible staff immediately to address the issue. If unresolved, submit a written complaint to Élite Diving Agency™ within 28 days of returning. We will respond within 28 days of receiving your complaint.
At Élite Diving Agency, we are committed to preserving the natural marine environment. We believe in responsible, eco-friendly diving practices, and we require all participants to act with respect and care for the delicate ecosystems we interact with.
We reserve the right to cancel diving activities for any diver who does not adhere to environmental guidelines or acts in a manner that negatively impacts the environment. This includes, but is not limited to, touching or disturbing marine life, damaging coral reefs, or engaging in harmful activities that may disrupt the balance of marine ecosystems.
As part of our dedication to conservation, we encourage all our divers to support sustainable practices and minimize their environmental footprint during their activities. We also recommend participating in local conservation initiatives and beach clean-ups, as we strive to protect the beauty of our oceans for future generations.
Diving insurance is mandatory for all diving activities and trips. We highly recommend DAN insurance, which you can find more information about on our “Quality Certified Partners” page on our website or HERE.
This Agreement, its interpretation, and execution are governed by UAE law and subject to UAE jurisdiction.
